When you buy a house and something is wrong with it, chances are the negligent misrep and fraudulent misrep claims are barred by the economic loss rule. More important to this case is the warning to all: If you purchase a 23 year old home that was used as a rental property, you may want to get it inspected (one guess who assumed the risk that a house you fail to get inspected might not be awesome...I won't make you wait for the answer...the plaintiff).
