One new opinion out of Division III:
Eminent domain? Kind of falls under land use. But, given the importance of the topic, I will refrain from calling land use attorneys nerds...but just this once.
RCW 14.07.020 empowers municipalities to condemn for a public purpose. The city of Spokane and Spokane County creating a board to operate Spokane International Airport. The Board needed to clear a line of sight for a new tower, and RMA was leasing some of the doomed structures. The board condemned the buildings. Unfortunately, the power to condemn, per statute, lies in the city and the county. Thus, the city and the county can condemn and leave the "ministrial functions" to the Board, but their delegation to the Board for actual condemnation was excessive.
